Terms of Service

1) Using Our Site and Services

By accessing our website or renting a trailer, you agree to these Terms. If you do not agree, do not use the site or rent.

2) Rentals, Booking, and Payments

  • Eligibility. Renter must be 21+ with a valid driver’s license and an insured, properly equipped tow vehicle.

  • Booking fee. A $50 non-refundable booking fee secures your date and is applied to your rental total. Balance is due before pickup or delivery.

  • Pricing. Prices, taxes, and delivery fees are shown at checkout before payment. No hidden fees.

  • Delivery. Local delivery may be available within our service area; fees shown at checkout or quoted in writing.

  • Cancellations. Cancel ≥24 hours before pickup/delivery: booking fee is forfeited, no other charge. Cancel <24 hours: additional fees may apply.

  • No assignment. Reservations are not transferable without our written consent.

 

3) Renter Responsibilities and Safety

  • Tow vehicle. You are responsible for confirming your vehicle’s towing capacity, brake controller, hitch size (2-5/16”), and 7-way plug.

  • Weight limits. Obey GVWR and payload limits. For payloads over ~5,000 lbs, we strongly recommend a ¾-ton or larger truck (e.g., F-250/Silverado 2500/Ram 2500).

  • Use. On-road use only. No off-road, racing, illegal, or hazardous materials.

  • Care. Inspect equipment before leaving. Use proper straps/tie-downs. Follow all laws.

  • Loss/Damage. You are responsible for loss, theft, damage, cleaning, and late returns from the moment you take possession until return is completed and checked in.

  • Breakdowns. Contact us immediately. Do not continue operation if unsafe.

 

4) Condition; Denial of Service

We may refuse, cancel, or end a rental for safety, non-payment, lack of required documents, suspected misuse, or weather/operational concerns. If we cancel for our reasons before pickup/delivery, your booking fee will be refunded.

 

5) Insurance; Risk Allocation

  • Your insurance. You represent that your auto policy covers towing/operation of rented trailers. You remain primarily responsible for liability and property damage while the trailer is in your control.

  • Our coverage. Our company maintains coverage for our business interests; it does not replace your obligations.

  • Indemnity. You agree to defend, indemnify, and hold Just Hitched and its owners harmless from claims, damages, fines, and costs arising from your use, operation, loading, or transport.

 

6) Website Use

  • License. We grant a limited, revocable license to access the site for personal, non-commercial use of our services.

  • Prohibited. No scraping, reverse engineering, security circumvention, or unlawful activity.

  • Content. Text, logos, photos, and media are our property or used under license.

 

7) Disclaimers

Services and equipment are provided “as is” and “as available.” We disclaim all warranties to the fullest extent allowed by law, including fitness for a particular purpose. You are responsible for confirming suitability for your haul and vehicle.

 

8) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for amounts exceeding the greater of (a) the fees you paid for the affected rental or (b) $300.

 

9) Changes, Availability, and Errors

We may update prices, availability, specs, and these Terms at any time. The version posted at the time of booking controls that booking.

 

10) Governing Law; Dispute Resolution

These Terms are governed by Texas law. Venue is Harris County, Texas. You agree to first attempt informal resolution by emailing info@justhitchedtrailer.rentals. If unresolved after 30 days, disputes will be brought in state or federal courts located in Harris County. Jury trial is waived to the extent permitted by law.

 

11) Severability; Entire Agreement

If any provision is unenforceable, the remainder stays in effect. These Terms plus your signed/online rental agreement are the entire agreement.
